Court Denies Safeguard’s Motion to Dismiss

In a putative class action filed by Leist Warner, Judge David Branstool of the Licking County Court of Common Pleas recently denied Defendant Safeguard Properties’ request to dismiss the Plaintiff’s complaint. In her complaint, the Plaintiff alleges that she and other homeowners were the victim of Safeguard Properties’ illegal entry into their homes while the Plaintiff and other homeowners were legally residing in their homes. The Plaintiff further alleges that in the course of illegally entering the homes of the Plaintiff and other homeowners, Safeguard Properties damaged their homes, took personal property and committed other illegal acts. The Plaintiff in the case, which seeks class action status, is represented by Leist Warner, LLC.
