Sawed-Off Shotgun . . . CASE DISMISSED!

 

Darrin Leist successfully defends man indicted with Weapons Under Disability (O.R.C. 2923.13(A)(3)) and Unlawful Possession of Dangerous Ordinance or Processing Explosives (O.R.C. 2923.27(A)).  Upon entering the residence of his client, a previously convicted felon, investigators discovered a sawed-off .20 gauge shotgun positioned in plain view on a couch in the living room. Leist challenged the prosecution of his client on the basis that the complainant who summonsed law enforcement to the residence failed to appear at trial, rendering law enforcement unable to justify their presence in the absence of the witness and her testimony.  CASE DISMISSED!
